This Privacy Policy explains how information is collected, used, and disclosed when you visit realtorNickRogers.com, use our property-search tools or AI Real Estate Genie, subscribe to updates, or contact us about residential real estate.
Information We Collect
Depending on how you use the website, we may collect:
- Contact information you choose to provide, such as your name, email address, mobile number, and property address.
- Real-estate inquiry information, such as desired locations, price range, bedrooms, bathrooms, property features, listings viewed, showing requests, seller timing, and the text of your request.
- SMS consent records, including the mobile number, consent status, date and time, source page, disclosure text/version, and later opt-out or re-opt-in events.
- If you allow visitor identification, we may receive identity and contact information matched to your visit by LeadPost, as described below.
- Technical and usage information, such as IP address, browser/device information, pages visited, referring pages, and interactions with website features. We may use cookies and similar technologies for security, functionality, analytics, and performance.
How We Use Information
We may use information to provide and improve property searches; respond to buyer, seller, valuation, listing, and showing inquiries; remember a Genie conversation during a browsing session; deliver requested real-estate communications; operate and secure the website; measure site performance; comply with law; and protect our rights.
The AI Real Estate Genie is a residential real-estate search and inquiry tool. It is not a mortgage or lending messaging program. Mortgage and lending questions are redirected away from the Genie and are not used to initiate automated SMS through this program.
Optional Voice Search
If your browser supports voice recognition, you may choose to tap the microphone and speak a property-search request. Your browser will request microphone permission and may process audio using a recognition service operated by the browser provider. The website receives the resulting transcript and handles it like a typed Genie search. The Genie does not intentionally store the raw audio recording. Voice search is optional, and you can always type instead.
SMS and Mobile Information
If you affirmatively opt in, Nick Rogers Real Estate may send text messages concerning your real-estate inquiry, property searches, listings, showing requests, and related real-estate services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of receiving real-estate services.
Mobile information and SMS opt-in or consent information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. We may disclose information to service providers that help us deliver and support the messaging program, solely for those operational purposes, or when required by law. Text-message originator opt-in data and consent will not be sold or used for unrelated marketing.
Opt-out requests are effective for future automated messages from this real-estate messaging program. We retain consent and opt-out records as reasonably necessary to honor your choices and maintain an audit trail.
How Information May Be Disclosed
We may disclose information to providers of website hosting, WordPress functionality, IDX/property searches, visitor identification and contact matching, analytics, email, form processing, security, and SMS delivery. Some providers process information on our behalf; others may process information for their own purposes under their privacy terms. Providers of analytics and advertising services may collect or combine identifiers and online activity over time and across different websites. Our visitor-identification service and your choices are described below. We may also disclose information when required by law, to protect safety or rights, or as part of a business transfer. Separately operated third-party services have their own privacy policies.
IDX Listings and Third-Party Services
Property information is supplied through third-party IDX/MLS services and may link to listing-detail pages or other services. The site may also use analytics, mapping, anti-spam, embedded content, and newsletter services. Those providers may collect information under their own privacy policies. Listing data is informational and may change without notice.
Cookies and Analytics
Cookies and similar technologies may support core site functions, maintain a session, prevent abuse, understand traffic, and improve performance. Browser settings may allow you to limit cookies, although doing so can affect site functionality.
Microsoft Clarity was disabled on this website on September 24, 2026. Before it was disabled, we used Clarity for clicks, scrolling, page interactions, session replay, and heatmaps. Disabling Clarity does not delete previously collected information. Microsoft may retain and process previously collected information under its Microsoft Privacy Statement.
Optional visitor identification
With your permission, we use LeadPost to help identify some visitors to this website. Visitor identification is optional and is off until you affirmatively allow Advertising & Visitor Identification through our privacy controls. Accepting allows LeadPost to receive IP addresses, browser and device information, cookie or other online identifiers, pages visited, referring pages, and visit activity, and to match that information with its identity services and other sources. Where a match is available, Nick Rogers Real Estate may receive your name, email address, mailing address, and visit information. We may use that information to understand interest in our real estate services, manage prospective customer information, and personalize real estate advertising and marketing, including marketing emails. This can occur even if you do not submit a contact form. See the LeadPost Privacy Policy for its practices and available choices.
You can choose Accept, Reject, or Manage Preferences in the banner. You can browse property listings and use requested Genie features without agreeing to visitor identification. Optional analytics and Microsoft Clarity session replay remain disabled.
LeadPost may combine identifiers and activity across websites or devices under its own privacy terms. Disclosures and uses for identity matching or advertising may constitute a sale or sharing of personal information under applicable privacy laws. An identity match is not proof that you submitted a form or requested contact. Simply visiting this website or reading this policy is not consent to optional visitor identification. Our restrictions on sharing mobile information and SMS consent for third-party marketing remain in effect.
Changing your choices
Your privacy choice is stored in a first-party cookie and browser storage for up to 180 days, with a timestamp and disclosure version. We may ask again after it expires or when the disclosure changes. Choices apply to the browser in which they are made and may be lost when you clear storage or use another device or browser. Privacy Choices in the footer lets you review or change your choice at any time. When we detect Global Privacy Control or Do Not Track, visitor identification stays off in that browser.
Withdrawing permission stops future LeadPost loading and, if it has already loaded, reloads the page to stop it. We also remove the known LeadPost identifiers accessible to this website. This does not erase information already collected, remove every third-party cookie, or unsubscribe you from marketing emails. Use the unsubscribe link in an email or contact nick@realtornickrogers.com for an email opt-out or other privacy request. Other embedded or third-party website services have their own data practices and controls.
Text messages and calls are separate
Accepting visitor identification does not authorize text messages or phone calls. Request text updates from Nick opens a separate form. To receive texts, enter your mobile number, review the SMS disclosure, and check the optional SMS consent box before submitting. The box starts unchecked. You can request real estate assistance without agreeing to text messages. The existing SMS and Mobile Information section of this policy continues to apply, including STOP/HELP instructions and the restriction on sharing mobile numbers and SMS consent for others’ marketing.
Call Nick opens your device’s calling function. It does not enroll you in texts or grant permission for automated marketing calls.

Data Retention and Security
We retain information for as long as reasonably necessary for the purposes described above, to provide requested services, and to meet legal, security, and recordkeeping obligations. We use reasonable administrative and technical safeguards, but no internet transmission or storage method is completely secure.
Your Choices
You may decline to provide optional information, use the property search without consenting to SMS, unsubscribe from email using the link in an email, or opt out of text messages by replying STOP. To ask about, correct, or delete personal information, contact us using the details below. We may need to verify your identity and may retain information when legally permitted or required, including consent and opt-out records.
Where applicable law grants them, California residents may request access to or a copy of personal information, deletion, correction, and an opt-out of sale or sharing, and may exercise applicable rights without unlawful discrimination. Contact nick@realtornickrogers.com to submit a request concerning information held by us. An authorized agent may contact us on your behalf; identity or authority verification may be necessary. You can also opt out of LeadPost visitor identification on this browser. A browser opt-out does not automatically delete existing records or unsubscribe you from marketing emails. For information held independently by LeadPost, use the privacy request options in its privacy policy linked above.
Children
This website is intended for adults seeking real-estate information and is not directed to children under 13. We do not knowingly collect personal information from children under 13.
Changes to This Policy
We post changes to this policy on this page and update the Last updated date. This is how we notify visitors of material changes to our privacy practices. We provide additional notice or obtain consent when required by applicable law.
